Teens Accused in Toledo Teen’s Dragging Death Face Judge as Family Demands Justice

Three teenagers accused in the death of Joaquin Simmons appeared before Judge Amy Stoner on Tuesday, where prosecutors confirmed all three will be tried as adults. The court appearance comes weeks after Simmons, known affectionately as Wak, was killed during what authorities say was a robbery that turned violent.

Outside the juvenile detention center, Simmons’ family and supporters held a passionate protest. They held signs reading “Justice for Joaquin” and carried photos of the young man, demanding accountability and answers.

“You do big boy crimes, you go across the street,” said Joe Garza, Simmons’ uncle, referring to the move from juvenile court to adult court.

The incident occurred last month at the intersection of Streicher and Mulberry, where police responded to reports of a robbery. They found Simmons lying in the street with severe injuries. Investigators say Simmons had arranged to meet the teens to sell a pair of shoes through Facebook Marketplace. During the exchange, an argument broke out over the price. One of the suspects allegedly tried to steal the shoes and grabbed Simmons by the hair. The driver then sped off, dragging Simmons along the road. He suffered a traumatic brain injury and died in the hospital a few days later.

“He just believes and sees the good in everybody,” said Garza. “So, when somebody takes advantage of him like this and drags him to death, we need justice. The whole community needs justice.”

According to the prosecutor, one of the teens has since turned 18, while the other two are now 17. Three of the charges they face require that they be prosecuted as adults.

One defense attorney requested that his client be released from custody, arguing that the teen wasn’t driving the vehicle and had a supportive family willing to help him meet any court requirements. The prosecutor objected, pointing out the teen’s prior conviction involving a weapon, and urged the judge to keep all three suspects detained.

Judge Stoner denied the release request and ordered that all three teens remain in custody. Attorneys for the other two defendants did not comment following the hearing.
