Ohio Mother Sues School District After 8th-Grade Daughter Allegedly Strip Searched Over Vape Pen

April 15th, 2024-CLEVELAND, Ohio-A mother is suing an Ohio school district, alleging a nurse’s aide strip-searched her middle school daughter. The federal lawsuit, filed against Willoughby-Eastlake Schools Board of Education and three employees, claims constitutional rights violations, failure to train staff, and emotional distress.

The incident occurred after a student asked the eighth-grader to hold a vape pen, leading to a search by the school’s principal. The lawsuit alleges the student was then forced to strip to her underwear by a nurse’s aide, Rosalyn Rubertino, under instructions from the school nurse Megan Kuhlman, who wasn’t present. The search yielded nothing, yet the student was suspended. Legal experts emphasize the need for schools to have “reasonable evidence” before strip-searching students for safety reasons.
