COLUMBUS, Ohio-Ohio’s state universities are reevaluating their scholarship programs after Attorney General Dave Yost suggested that considering race in awarding funds might be unconstitutional, following the Supreme Court’s decision in Students for Fair Admissions v. Harvard. Yost’s warning prompted seven state universities to review their race-conscious programs, including scholarships.
The Supreme Court’s rulings suggest that diversity can still be a compelling state interest, but programs considering race must pass strict scrutiny and demonstrate a measurable and concrete justification.
Some schools are exploring alternative strategies for achieving diversity, such as considering socioeconomic status, ZIP codes, academic achievements, and contributions to society. However, challenges persist as critics question the legality of race-conscious programs in scholarships and financial aid, including those funded externally.
