Grand Jury Decides if man Accused of 3-Year-Old Girl’s Murder Should Face Death Penalty

SANDUSKY, Ohio-An Erie County grand jury will meet next week to determine if Devin O’Brien, accused of murdering a 3-year-old girl, should face death penalty charges. O’Brien was arrested on September 12 after calling 911 to report the girl missing; her body was later found near his home. The child had recently moved in with O’Brien and was alone when her mother was in Cleveland. Erie County Prosecutor Kevin Baxter noted that the death penalty could apply in this case, particularly given the aggravated circumstances of the crime, which included strangulation, blunt force trauma, and signs of sexual assault. O’Brien, who expressed affection for the girl during his arrest, is currently held on murder charges, with potential additional charges pending as the investigation continues.
