March 27th, 2024-The ACLU of Ohio and law firm Goodwin have filed a lawsuit against the state to block legislation limiting healthcare for transgender youth and banning trans athletes from girls’ sports. Representing two families, the lawsuit seeks to overturn House Bill 68 before its April 24 enactment, citing its cruelty, lack of scientific basis, and unconstitutionality. The bill’s override of Gov. Mike DeWine’s veto by the GOP-led Senate and House is challenged, citing an amendment from 2011 as unconstitutional. The lawsuit argues violations of the Ohio Constitution’s single-subject rule, Health Care provision, Equal Protection Clause, and Due Course of Law provision. Freda Levenson, ACLU’s legal director, emphasizes the importance of personal medical decisions remaining between families and physicians. Ohio House Rep. Gary Click, the bill’s sponsor, anticipates the lawsuit but expresses confidence in defending the legislation, citing similar laws upheld in other states.
